(1) PURPOSE. The Federal Asbestos Hazard Emergency Response Act (AHERA, P.L.99-519) of 1986 requires that person who conduct asbestos-related work in schools must receive certification from accredited programs in order to inspect school buildings for asbestos, develop management plans, and design or conduct response actions. If the state chooses to have authority for the Clean Air Act, the state is required to adopt an accreditation program at least as stringent as the Environmental Protection Agency (EPA) Model Accreditation Plan, 40 CFR 763, Subpart E, Appendix C.
(2) DEFINITION.
(a) For purposes of this program, all words used herein shall have the same meaning as defined and used in the pertinent Federal Register; ie.
1. Federal Register/Vol.52, No. 210/Friday, October 30, 1987/Rules and Regulations, EPA 40 CFR Part 763, Asbestos-Containing Materials in Schools, Final Rule and Notice.
2. Federal Register/Vol.52, No. 83/Thursday, April 30, 1987/Rules and Regulations, EPA 40 CFR Part 763, Asbestos-Containing Materials in Schools, Model Accreditation Plan.
(3) REQUIREMENTS.
(a) Local school systems shall be responsible for meeting all requirements stated in AHERA and shall engage only certified persons from accredited programs.
